Terms & Conditions

General

1. By using this website, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. Closed Canopy reserves the right to modify these Terms and Conditions at any time without prior notice.

 

2. Headings are for convenience only and do not effect the interpretation of these conditions.

3. These Terms and Conditions aim to protect all parties from unnecessary financial loss and dissatisfaction.

​

4. All prices are inclusive of GST and are subject to change without notice.

​​

5. While every effort is made to ensure the accuracy of information on this website, no guarantee is given regarding its completeness or correctness. If pricing or product details are found to be incorrect after an order is placed, the order may be cancelled and fully refunded.

6. Content from this website may not be used, copied, modified, adapted, transmitted, stored, published, or distributed without prior written consent from Closed Canopy, except as permitted by applicable law. Additionally, this website must not be used for commercial purposes in a way that disadvantages Closed Canopy.

Delivery

7. Delivery is currently limited to locations within Victoria, Australia.

​

8. At checkout, a preferred delivery date can be selected from the available options, which reflects a conservative lead time for order preparation and dispatch. Deliveries are made Monday to Friday, excluding public holidays.

9. Within 10 business days of placing an order, the delivery date will be confirmed. If the preferred date is unavailable, the closest possible alternative will be proposed. If this is unsuitable, another date within five business days of the proposed date may be requested. If no suitable date can be arranged within this timeframe, the order may be cancelled, and a full refund issued.

 

10. Notification must be provided within two business days if the proposed delivery date is unsuitable. If no response is received, the proposed date will be considered confirmed.

11. Someone must be present to receive and inspect the delivery, unless authority has been given at checkout for it to be left unattended. If delivery is delayed because nobody is present, holding fees may apply at Closed Canopy’s discretion.

12. Delivery is limited to curbside unloading only, in accordance with occupational health and safety requirements.

Local Pickup

​

13. At checkout, a pickup location can be selected from the available options. Local pickup is available from selected partner nursery sites across Victoria.

​​

14. Pickup is available Monday to Saturday, excluding public holidays, during standard trading hours. If collection is delayed by more than five business days after notification, holding fees may apply at Closed Canopy’s discretion.

​​

15. A confirmation email may be requested upon collection. Collection is limited to the purchaser unless alternative arrangements are made in advance.

​

16. Responsibility for the goods transfers upon pickup. Closed Canopy is not liable for damage or loss after collection.

Returns

 

17. In the unlikely event that product sourcing becomes unviable for any reason, the order will be cancelled and fully refunded.

​​

18. Cancellations by the purchaser may be subject to a cancellation fee of up to 100% of the order value at Closed Canopy’s discretion.

​​​

19. Returns of living products cannot be accepted once pickup or delviery is completed. This ensures compliance with biosecurity regulations designed to prevent the spread of pests and diseases. These are governed by the Biosecurity Act 2015, relevant state legislation, and supplier imposed protocols.

​

20. If any plant is found to be damaged or unhealthy at the time of pickup or delivery, Closed Canopy will work in good faith with its suppliers to investigate and resolve the issue. If the supplier confirms the issue, a refund will be arranged for the affected plant at Closed Canopy’s discretion.

21. Written notification of any damaged or unhealthy plants must be provided on the day of collection or delivery. For convenience, this can be done via the Contact Us page. If collecting from a partner nursery, a replacement may be provided at the time of pickup, but written notification is still required to ensure replacement fees are not inadvertently incurred.

22. Returns for change of mind cannot be accepted.​
